DEFENDANTS’ ALLEGED MISCONDUCT: The complaints allege that throughout the class period, the defendants made materially false and misleading statements and failed to disclose material adverse facts about the company’s business, operations and prospects, including that: (1) Acadia Healthcare was accepting patients and held them against their will and beyond the period of time medically necessary to pay tricked them into continuing to pay for the care of such patients; (2) Acadia Healthcare will not discharge patients until their insurance expires; (3) to accomplish the above, Acadia Healthcare hired company evaluators to pressure emergency rooms to send patients to company facilities, filed frivolous petitions with courts to delay patient releases, and instructed employees to use phrases and avoid using other words in charts patients to create false impression of patients’ mental state; (4) Acadia Healthcares admission, length of stay and billing practices would expose the company to government investigations and actions and increased media scrutiny; (5) in light of such governmental investigations and actions and media scrutiny, Acadia Healthcares’ relationships with its referral sources would be adversely affected; (6) as a result of the above, Acadia Healthcare experienced slower same-store patient volume, and in turn, the company would be forced to lower its 2024 outlook for the full year; and (7) as a result of the foregoing, the defendants’ positive statements about the company’s business, operations and prospects were materially false and misleading and/or lacked a reasonable basis at all relevant times.
